1. Acceptance of terms

By downloading, installing, or using the luvu mobile application or website (“the Service”), operated by Subatix Inc., you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, do not use the Service.

2. Service description

luvu is an experience-first dating platform that matches users for curated real-world experiences such as dining, cultural outings, outdoor activities, and wellness sessions. The Service facilitates matching based on shared experience preferences and availability, and provides limited in-app communication between matched users. The Service is currently available in New York City. Features, availability, and functionality may change at any time.

3. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are at least 18 years of age, that you have the legal capacity to enter into these terms, and that you are not prohibited from using the Service under applicable law.

4. Account registration and security

You create an account using Sign in with Apple. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate and truthful information in your profile, including your name, age range, gender, and photos. You may not impersonate another person or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.

5. User conduct

You agree to use the Service respectfully and lawfully. You may not:

• Submit false, misleading, or fraudulent information
• Harass, threaten, abuse, or intimidate other users
• Send spam, unsolicited messages, or commercial content
• Upload content that is illegal, harmful, hateful, discriminatory, sexually explicit, or violent
• Attempt to access other users' accounts or private data
• Use automated tools, bots, scrapers, or other programmatic means to interact with the Service
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service for any purpose that violates applicable law

6. User content

You retain ownership of the content you submit (photos, messages, profile information). By submitting content, you grant Subatix Inc. a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating and improving the Service. You are solely responsible for the content you submit and represent that you have the right to share it.

7. Matching and experiences

luvu facilitates introductions between users through shared experiences. We do not guarantee that you will receive matches, that matches will lead to successful connections, or that experience venues will be available. We are not responsible for the conduct of any user before, during, or after an experience. You participate in all experiences at your own risk. We encourage users to meet in public places and to exercise reasonable personal safety precautions.

8. Safety and reporting

If you experience or witness behavior that violates these terms or makes you feel unsafe, please report it to us immediately at contact@subatix.com. We take reports seriously and may take action including warning, suspending, or permanently banning users who violate our policies.

9. Intellectual property

All content, design, trademarks, and code of the Service are the property of Subatix Inc. and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without prior written consent from Subatix Inc.

10. Termination

You may delete your account at any time through the app. We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these terms or is harmful to other users or the Service. Upon termination, your right to use the Service ceases immediately.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of liability

To the maximum extent permitted by law, Subatix Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or emotional distress arising from your use of the Service or your interactions with other users. Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim.

13. Governing law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in New York County, New York.

14. Changes to terms

We may update these Terms of Use at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
